The House of Representatives’ prosecution team has filed a motion for reconsideration before the Supreme Court (SC) on Monday, August 4.
Following the high court’s decision to declare the articles of impeachment against Vice President Sara Duterte, RH Milky Rigonan reported that the House Prosecution team submitted a motion for reconsideration through the Office of the Solicitor General and the Philippine Judiciary portal on Monday afternoon.
The deadline for the said document was scheduled for August 11th.
‘Restoring Balances’
Meanwhile, House Speaker Martin Romualdez said in a video message that the filed motion for reconsideration is a way to restore balances, not assert supremacy.
“Because if impeachments can be blocked by misunderstood facts, or rules made out to the fact, then accountability is not upheld; It is denied,” he emphasized.
According to Romualdez, the act of insisting on constitutional integrity is also a way to strengthen democracy in the country.
“We speak now not because it is easy, but because it is necessary. The House will not bow in silence,” he said in closing.
The SC struck down the impeachment complaint against Duterte last month, declaring it unconstitutional as it violated the one-year bar rule under Article XI, Section 3(5) of the Constitution and the right to due process enshrined in the Bill of Rights.
Senate President Francis “Chiz” Escudero announced during a Senate session last month that the impeachment court would decide on the SC’s impeachment ruling on the Vice President by August 6th. This is to give them time to review the 97-page decision.
