The Commission on Elections (Comelec) Second Division on Friday canceled the registration of Visayas-based An Waray party-list over the violation it committed in the 2013 National and Local elections.

In a press statement, Comelec spokesperson John Rex Laudiangco said the party-list failed to comply with Section 6(5) of Republic Act No. 7941 as it allowed a second nominee, Victoria Isabel Noel to seat as House member even though it know “fully well” that it won only one House seat in the 16th Congress.

He added that Noel was still given a seat even without a certification of proclamation.

In 2013, An Warray was entitled to two seats in the lower chamber after winning the party-list race.

“However, the initial allocation of two seats was subsequently recomputed to be one only, pursuant to NBOC Resolution No. 13-030 (PL) / 004-14 promulgated on 20 August 2014,” Laudiangco said.

“Further, NBOC Resolution No. 008-13, promulgated on 28 May 2013, which An Warray solely relied on as the basis for allowing its second nominee to take her oath and assume office as Representative in the HoR, expressly stated that the seats initially allocated is “without prejudice to the proclamation of other parties, organizations or coalitions which may later on be established to be entitled to one guaranteed seat and/or additional seat,” he added.
