The Senate has stood its ground against Pacifico “Curlee” Discaya’s Writ of Habeas Corpus, which alleges irregularities in his detention under the legislative body.
“The Senate remains firm in its decision, asserting that the contempt order against Discaya was issued within its constitutional authority,” the Senate said in a statement, after confirming receipt of the habeas corpus.
According to the Senate’s statement, the Pasay City Regional Trial Court (RTC) Branch 298 ordered that Discaya remain “under the safekeeping of the Senate Sergeant-At-Arms,” although the case is set to resume on Monday, 9:00 a.m.
In an interview on DZRH’s Damdaming Bayan on Wednesday, the Discaya couple’s lawyer, Atty. Cornelio Samaniego III said that he earlier filed a motion for reconsideration in the hopes of lifting the contempt order, then filed a second, urgent motion to resolve it—both of which fell on deaf ears. This compelled him to resort to filing a case in court.
