Senator-judge Raffy Tulfo questioned Monday whether a conflict of interest arose from GenCorp’s participation in public bidding in Davao City, where Vice President Sara Duterte was allegedly a shareholder and her brother was the city’s mayor at the time.

The exchange took place on the 30th day of Duterte’s impeachment trial as the Senate impeachment court continued examining Article II of the impeachment complaint concerning the Duterte’s alleged unexplained wealth.

Tulfo asked whether GenCorp should have been allowed to participate in Davao City government procurement given Duterte’s reported ownership in the company and her family’s political ties to the city.

“Allowed ba ang GenCorp na mag-participate sa public bidding sa Davao knowing na si VP Sara ay isa sa mga may-ari ng GenCorp and then yung Davao is balwarte niya, and so wala bang conflict of interest doon?” Tulfo said.

House prosecutor Rep. Gerville Luistro said GenCorp should not have participated in Davao City bidding if Duterte’s statements of assets, liabilities and net worth (SALNs) established that she was a shareholder of the company.

“If there are SALNs already which the respondent vice president herself acknowledged, admitted that she is part of this corporation then GenCorp should not be participating in the city of Davao, which is headed by no less than the brother of the respondent vice president,” Luistro said.

Luistro acknowledged that procurement rules were not explicit on the particular scenario but argued that the arrangement constituted the conflict of interest contemplated under Article VII, Section 13 of the 1987 Constitution.
