Securities and Exchange Commission (SEC) Director Gerardo Del Rosario acknowledged during Day 28 of Vice President Sara Duterte’s impeachment trial that his earlier discussion of a possible trust agreement involving Duterte and GenCorp Industries Inc. was based only on a possibility, not a specific finding.
Defense counsel Justin Nicol Gular asked Del Rosario whether the SEC records he reviewed contained any voting trust agreement or certificate of trust concerning GenCorp.
Del Rosario replied that there was no application for such an agreement.
Gular then asked whether Del Rosario’s statements about a possible trust agreement were based on speculation. The prosecution objected, saying the characterization was misleading.
Presiding Officer Chiz Escudero allowed Del Rosario to answer, noting that the SEC official could clarify whether he was speculating.
Del Rosario explained that he was not claiming that a trust agreement existed between Duterte and GenCorp.
“Yung pong tungkol sa trust agreement ay hindi ko naman po pinapatungkol na meron itong kumpanya na ito. Kundi umiisip lang po, tinatanong ko, kung meron bang posibilidad na nangyayari ito. Yun lang po, kuro-kuro ko,” Del Rosario said.
Gular then asked the witness to confirm that the trust agreement scenario was only a possibility or “kuro-kuro.”
