The Quo Warranto petition against Senator Erwin Tulfo was dismissed by the Senate Electoral Tribunal (SET) on Wednesday, due to insufficiency in form.

The petition was filed by Berteni “Toto” Causing, who accused Tulfo of disloyalty to the Republic, alleging that he is an American citizen, a member of a political dynasty, and lacking in academic qualifications.

In a three-page decision issued by the SET, it dismissed the quo warranto petition after finding that the petitioner failed to clearly establish its essential elements, including the petitioner’s legal standing, the respondent’s qualifications, and the proper grounds for disqualification.

The resolution was signed by Supreme Court Senior Associate Justice Marivic Victor Leonen as chairman of the SET, and Associate Justices Ramon Paul Hernando and Henri Jean Paul Inting.

Senators who serve as members of the SET were also in favor of the decision, including Senators Pia Cayetano, Robin Padilla, Kiko Pangilinan, Bam Aquino, and Camille Villar.
