The National Bureau of Investigation (NBI) said it will seek clarification from the court regarding the “not bailable” notation in the warrant of arrest issued against former broadcaster Jay Sonza.
According to NBI Director Melvin Matibag, the bureau will only be able to address the matter on Monday, following the Labor Day holiday and the weekend, as reported by RH Jecelle Ricafort on DZRH’s “Rapido Hataw Balita” on Friday.
Speaking to DZRH News, Matibag explained that the warrant states “not bailable,” but emphasized that this does not necessarily mean bail is prohibited.
He noted that if bail is allowed, the warrant typically indicates the recommended amount. The bureau plans to formally clarify the wording before the court.
The case against Sonza involves alleged “unlawful publication” under the Cybercrime Prevention Act of 2012, in connection with the supposed dissemination of a falsified medical record of President Ferdinand Marcos Jr.
Matibag denied any intention to time Sonza’s arrest when courts would be closed. He said the warrant was issued late in the afternoon of April 30 and was served later that evening.
The former broadcaster reportedly experienced difficulty breathing due to asthma and was given medical attention prior to being detained at the NBI detention facility.
Matibag added that no other arrest warrants have been issued so far against other individuals in relation to the same case.
Earlier, Sonza’s legal counsel, Atty. Mark Tolentino, questioned the legality of denying bail, arguing that the charges filed are bailable and not punishable by reclusion perpetua or life imprisonment.
