The Independent Commission for Infrastructure (ICI) has recommended the filing of criminal and administrative charges before the Office of the Ombudsman against several lawmakers and former government officials allegedly involved in anomalies surrounding flood control projects.

In a press briefing held on Wednesday in Taguig City, ICI Chairman Andres Reyes announced that the commission found sufficient basis to pursue cases for direct or indirect bribery and corruption of public officials against six individuals, RH Jecelle Ricafort reported.

The following lawmakers and former officials were named in the ICI report as respondents recommended for criminal and administrative prosecution in connection with the alleged flood control irregularities:

  • Former DPWH Undersecretary Roberto Bernardo

  • Senator Joel Villanueva

  • Senator Jinggoy Estrada

  • Former Ako Bicol Representative Zaldy Co

  • COA Commissioner Mario Lipana

  • Former Caloocan Representative Mitch Cajayon-Uy

Reyes said that they have "possibly committed" plunder, direct or indirect bribery, corruption of public officials under Articles 210, 211, and 212 of the Revised Penal Code and Sections 3b and 3e of RA 3019.

The ICI chairman emphasized that the ICI will not tolerate corruption within the government.

“With this filling we remain true to our commitment to the Filipino people. No one will be spared in this fight against corruption. Politicians and government officials will be investigated and charged by credible evidence. Those found responsible will face the consequences and be held accountable under the rule of law," Reyes said.

"To aspiring criminals, crime with that and does not pay we will continue to investigate, follow the evidence, pursue charges to the very last man involved. Justice will not be delayed this time. This is our promise to our countrymen," he added.

He added that the ICI will continue to investigate and file charges against erring officials and others who may have plundered public funds.

"Based on the testimonies and narrations of the witnesses, the scheme starts from the proponent, who is either a member of the Senate or the House of Representatives; who will inform Engr. Alcantara that he/she has a budget allocated for infrastructure projects," he said.

"Additionally, the scheme always involve flood control projects because the kickback which is 25% to 30% is much bigger than the kickback from other infrastructure projects which is only at 10%," the chairman added.

The ICI formally transmitted its findings and recommendations to the Office of the Ombudsman.

Reyes concluded by assuring the public that the commission’s work is guided by transparency.
