

The International Criminal Court (ICC) has granted former President Rodrigo Duterte’s request to waive his right to be present at the first status conference in his crimes against humanity case, according to an order released on Friday, May 22.
In a seven-page decision, the Trial Chamber III approved the defense motion allowing Duterte to be absent from the May 27, 2026, proceedings, but directed his legal team to submit by May 25 a written waiver signed by the accused to formalize the request.
The chamber also set a detailed schedule for the first status conference, which will be held publicly at the court’s headquarters in The Hague. Proceedings are set to run in three sessions: 9:30 a.m. to 11:00 a.m., 11:30 a.m. to 1:00 p.m., and 2:30 p.m. to 4:00 p.m.
Judges said the conference will cover key procedural matters ahead of trial, including the possible start date and deadlines leading up to proceedings.
Prosecutors are expected to provide updates on the scope of their evidence, including the number of witnesses and the volume of documentary and other materials to be presented. The chamber will also discuss the use of expert witnesses, video-link testimony, and applicable evidentiary rules.
Other agenda items include agreements on undisputed facts, language and translation requirements, and the prosecution’s ongoing disclosure obligations, particularly the timing and extent of releasing evidence to the defense.
The chamber will further address witness protection measures, potential additions to the charges, and pre-trial motions that must be resolved before the trial begins.
Despite the public nature of the hearing, judges noted they may move parts of the conference into a private session if sensitive information, especially concerning witness security, arises.
In the same order, the chamber rejected a request by the victims' legal representative to attend the first status conference remotely.
The court added that other matters raised by the parties may be taken up in future status conferences as preparations for trial continue.
