

The Department of Labor and Employment (DOLE) has reminded companies to ensure that holiday or Christmas party activities respect employees’ culture, religion, and personal preferences.
RH Boy Gonzales reports that the advisory comes amid social media discussions about alleged cases where employees were forced to dance during office Christmas parties.
The National Labor Relations Commission (NLRC) clarified that workers may file complaints if they are coerced or threatened with penalties for refusing to participate.
Under the Labor Code, employees can only be penalized for legitimate causes such as misconduct, gross negligence, or other violations directly related to their work.
Coercion or threats of disciplinary action during non-work-related activities could entitle employees to claim damages through the NLRC. Complaints may also be filed if such pressure amounts to constructive dismissal.
DOLE further noted that violations could also fall under the Safe Spaces Act, depending on the circumstances. However, if participation is entirely voluntary and part of a festive gathering, the agency encourages employees to join freely and enjoy the celebration.
