The Department of Justice (DOJ) on Wednesday said that, based on the findings from its initial investigation, the Senate building had not been under attack during the May 13 shooting incident.

In a press conference, DOJ Secretary Fredderick Vida declared the Office of the Sergeant-At-Arms’ actions during the incident to be entirely unacceptable, according to the department’s special panel of prosecutors, formed to probe this specific incident.

“The action taken by the OSAA against the NBI on May 13, 2026 was not justified. Second, the Senate building was not under attack on the night of May 13, 2026,” Vida said.

Moreover, Vida warned that individuals who aided in Senator Ronald “Bato” Dela Rosa’s escape from Senate premises following attempts to serve his arrest warrant, issued by the International Criminal Court (ICC), will be held accountable.

“Third, the NBI attempted to implement the arrest warrant to Senator Ronald ‘Bato’ Dela Rosa. And fourth, when the ICC warrant was unsealed on May 11, 2026 and made public, any person who helped him escape may be held liable,” Vida told reporters.

On May 15, Vida announced that a prosecution panel was formed to conduct a case build-up investigation into the incidents that occurred at the Senate from May 11 to May 14.
