

The legal camp of government contractor Curlee Discaya continues to press for his immediate release from Senate custody, criticizing the Senate’s contempt order as unjustified.
According to a report on Magandang Umaga Pilipinas by RH Jecelle Ricafort, Discaya’s legal counsel, Atty. Cornelio Samaniejo III told DZRH News they have filed a 'petition for certiorari' before the Pasay City Regional Trial Court (RTC).
He stressed that Discaya should be released if the court rules in their favor.
Samaniejo emphasized that although Discaya is undergoing a preliminary investigation, there is "no pending criminal case or arrest warrant" against him.
He added that the court has already directed both parties to submit their respective memoranda. Once the simultaneous filing is completed, the case will be deemed submitted for resolution, with no further hearings scheduled.
According to Samaniejo, the Senate’s basis for citing Discaya in contempt is far removed from a legitimate investigation in aid of legislation. He pointed out that the contempt stemmed from the differing explanations given by Discaya and his wife regarding the absence of Sarah Discaya at a Senate Blue Ribbon Committee hearing—an absence that, he said, was already explained through a formal letter.
Earlier, Discaya’s eldest child sought a 'Christmas furlough' for his father, but the request was denied by Senate leadership.
At present, Curlee remains under Senate custody, while his wife, Sarah, is being held at the Lapu-Lapu City Jail in Cebu.
