Contractor Curlee Discaya will remain in the custody of the Senate after the Pasay City Regional Trial Court dismissed his petition for a writ of habeas corpus seeking his release from the Upper Chamber, as reported by RH Jecelle Ricafort.
The legal counsel of the Discaya family, Atty. Cornelio Samaniego III, confirmed to DZRH News that their petition was denied but declined to provide further details or comment.
In its ruling, the court dismissed the claim from Discaya’s camp that the Senate had committed grave abuse of discretion in imposing contempt sanctions.
Discaya was detained by the Senate Blue Ribbon Committee on September 18 for allegedly lying during the investigation into the flood control scandal.
Speaking on DZRH’s Damdaming Bayan, Atty. Samaniego said, “As an officer of the court, we have to respect the decision of the court, whether favorable or not. There are still legal options to contest the decision, and other legal avenues that may follow.”
He added that while an appeal is possible, time constraints are a challenge.
Samaniego also noted that Discaya has accepted the court’s decision. The next steps from the contractor’s legal team are still being determined.
