Senator-Judge Alan Peter Cayetano raised the possibility of coordinating with the Sandiganbayan to allow detained senators to attend the impeachment trial of Vice President Sara Duterte, citing concerns over fair participation and complete deliberation in the Senate sitting as an impeachment court.

Cayetano said the court should consider enabling Senators Rodante Marcoleta and Jinggoy Estrada, who are currently detained, to observe proceedings and potentially participate in the trial, stressing the importance of their presence in evaluating witnesses and evidence.

“May I ask the members of this Court… to consider communication with the Sandiganbayan for the attendance of Senator [Rodante] Marcoleta and Senator Jingoy Estrada… allowing them to attend here might add to the integrity of the proceeding,” Cayetano said.

He argued that impeachment proceedings are “sui generis” and noted that ensuring the attendance of all senator-judges would help uphold fairness in the process, adding that their absence could affect voting outcomes.

Cayetano also suggested that the court and parties may further discuss the matter in a caucus or in-camera session for proper legal consideration.

Presiding Officer Senator Francis “Chiz” Escudero acknowledged the proposal and said the matter will be taken up with the senator-judges and, if necessary, with the parties involved.

“The chair notes the comments and requests of Senator Judge Cayetano and will consult the senator-judges regarding this matter… including whether or not we will enlist the comment and position of the parties to this case. So ordered,” Escudero said.

The development came amid ongoing impeachment proceedings against Vice President Duterte, where Escudero earlier clarified that at least 16 votes are required for conviction under the Constitution and Supreme Court jurisprudence.

The impeachment trial continues as senator-judges deliberate on procedural and evidentiary matters before the presentation of full arguments from both the prosecution and the defense.
