Financial forensic analyst Alexander “Alex” Cabrera said GenCorp Industries Inc. allegedly failed to pay ₱250 million in taxes on ₱1 billion in undeclared inflows from 2022 to 2025, following an interjection by Senate President Win Gatchalian during the impeachment trial of Vice President Sara Duterte on Monday.

During the 38th day of the trial, Gatchalian cited Cabrera’s report showing that the company’s ₱1 billion in inflows over the four-year period was not reflected in its balance sheet or income statement.

Cabrera clarified that the amount was also not reflected in the company’s income tax return.

Asked by Gatchalian whether GenCorp had failed to pay taxes on the undeclared inflows, Cabrera answered in the affirmative.

He estimated the unpaid taxes at ₱250 million, applying a 25% tax rate to the ₱1 billion amount.

“Basic po, 250 po. Ginagamit ko ng bagong rate na kahit at 25%, 250 million po,” Cabrera said.

Gatchalian then cited Cabrera’s report, which raised the possibility of piercing the corporate veil over the alleged tax nonpayment.

The senator asked whether shareholders could be held responsible for the corresponding tax liabilities if the corporate veil were pierced.

Cabrera agreed, confirming that the estimated ₱250 million in tax liabilities could be apportioned among the shareholders.
