The Bureau of Immigration (BI) said the Supreme Court’s directive to release Joseph Sy from detention does not constitute a final determination of questions surrounding his citizenship and identity.
In a statement released Monday, October 12, BI Commissioner Joel Anthony M. Viado said the bureau respects the high court’s resolution ordering Sy’s release upon compliance with the conditions set by the Court.
Viado clarified that the case before the Supreme Court involves an appeal in a habeas corpus petition concerning the legality of Sy’s detention, rather than a determination of his citizenship.
“We wish to emphasize that the Supreme Court's order concerns Mr. Sy's release from custody while judicial proceedings continue. It does not constitute a final determination of the questions surrounding his citizenship and identity,” Viado said.
The BI chief said the bureau is coordinating with the Department of Justice (DOJ) and the Office of the Solicitor General (OSG) to ensure the prompt and orderly implementation of the Court’s directive.
He added that the BI acted within its statutory mandate to investigate matters involving immigration status, identity, and citizenship documentation.
“The legal issues arising from that investigation remain subject to judicial determination,” Viado said.
The bureau said it would continue coordinating with the DOJ and OSG on appropriate legal steps in accordance with the Supreme Court’s directives.
The BI reiterated its commitment to upholding the rule of law, respecting judicial authority, and protecting the integrity of the country’s immigration system.
