Senator Ronald “Bato” Dela Rosa’s lawyer, Israelito Torreon, defended the senator’s departure from the Senate, rejecting claims that he “fled” while under Senate protective custody amid an International Criminal Court (ICC) arrest warrant.

In an interview on DZRH's Magandang Umaga Pilipinas on Monday, Torreon stressed that it is incorrect to describe the senator’s exit as an “escape.“

“No, hindi ‘yan tumakas,” Torreon said.

He argued that there was no valid warrant of arrest issued by a Philippine court, and emphasized that due process under the 1987 Constitution must be observed.

“Kasi there is no proper warrant of arrest that has been issued by a Filipino judge. Ang pinagtatalunan lang kasi dito kung kailangan ba siya idaan sa ating local judicial process, ang stand-for namin dyan, yung 1987 Constitution is supreme than any other treaties that we have or whatever conventions that we have,” he said, adding that the Constitution should prevail over international treaties in matters involving local judicial procedures.

Torreon further maintained that any surrender or arrest procedure must pass through domestic courts, citing constitutional protections and due process safeguards designed to prevent government overreach.

He also cited principles of customary international law, saying that democratic states generally implement arrests within their own judicial systems before any international transfer.

He added references to the International Covenant on Civil and Political Rights and the Universal Declaration of Human Rights, arguing that proper legal steps must be followed before any transfer to The Hague in the Netherlands.

Following Dela Rosa’s departure from the Senate, Torreon said he currently has no direct communication with the senator due to security concerns and fears that his location could be traced. According to him, the senator is only communicating through his family at present.

Torreon also said Dela Rosa’s decision to leave was made despite assurances from government officials that he would not be arrested. He stressed that the decision ultimately rests with the senator.

“That is a decision that only Senator Bato de la Rosa can make,” he said.

“As a lawyer, I can only give him... alternative courses of action. So it depends upon him kung maniniwala siya sa assurance ngayon ng Malacañang.”

The lawyer also recalled being present in Senate discussions during the period when the House of Representatives was expected to transmit an impeachment complaint. He said he was among those who discussed possible legal and procedural responses with several senators and legal counsels, including Senator Ronaldo Marcoleta, while awaiting developments.

He also mentioned conversations involving Sen. Alan Peter Cayetano and the lawyer of Cayetano, as well as Jimmy Bondoc, focusing on possible alternative courses of action.

“Andon kasama kami don except that ‘yung immediately the after nasali ako don sa caucus ng mga Senador while they are awaiting the impeachment complaint from the House of Representatives. Nandun po kami, nag-uusap-usap nila ni Sen. Marcoleta, Sen. Cayetano, yung lawyer ni Sen. Cayetano, ako at si Atty. Jimmy Bondoc to discuss about the alternative process of action that... they proposed to us likewise. And then may lull yun konti, lumabas muna ako sa, parang may pantry nila,“ Torreon said.

“So yun na... akala namin parang ano lang, parang paputok of course, pero yung sunod-sunod na…putukan na talaga ito,“ he added.

On May 14, Cayetano confirmed that Sen. Dela Rosa had already left the Senate, following the reading of a message from the senator’s wife.

As of reporting, there has been no direct statement from Dela Rosa himself addressing his current whereabouts or next steps.
