Baste Duterte files kidnapping complaint vs. gov't officials over ex-President's ICC arrest

Acting Davao City Mayor Sebastian “Baste” Duterte on Monday filed nine criminal complaints against several government officials and police generals under President Ferdinand Marcos Jr.'s administration over the arrest of former President Rodrigo Roa Duterte to the International Criminal Court (ICC).

In a Facebook post, Atty. Israelito Torreon, counsel for the former president, said that the charges were lodged before the Office of the Ombudsman-Mindanao at 8:55 a.m., including kidnapping, arbitrary detention, and other alleged crimes related to the former president’s surrender to The Hague-based tribunal on March 11.

Named respondents in the case are Interior and Local Government Secretary Juan Victor “Jonvic” Remulla, Defense Secretary Gilbert Teodoro Jr., Justice Secretary Jesus Crispin “Boying” Remulla, National Security Adviser Eduardo Año, and Justice Undersecretary Nicholas Felix Ty.

Also included were Philippine National Police (PNP) Chief Gen. Rommel Francisco Marbil, former Manila Police District Chief Gen. Nicolas Torre III, Prosecutor General Richard Anthony Fadullon, former PNP spokesperson Gen. Jean Fajardo, Markus Lacanilao, and Anthony Alcantara, along with other unidentified “John Does.”

Torreon confirmed on his social media post that the cases filed cover Kidnapping, Arbitrary Detention, Qualified Direct Assault, Serious Dishonesty, Gross neglect of duty, Grave misconduct, and Conduct prejudicial to the best interest of public service.

The complaint comes as the former president remains detained in The Hague on charges of crimes against humanity arising from the bloody anti-drug campaign during his administration.

Duterte’s camp has filed an appeal for his interim release, but the ICC’s confirmation of charges hearing, initially scheduled for September 23, has been postponed without a new date set.

In response, Department of Justice (DOJ) Secretary Boying Remulla, one of the officials named in the complaint, dismissed the case as “forum shopping” and claimed it was meant to disrupt his own application for the Ombudsman post.

“They want to make it impossible for the JBC to get the requirements that I have to submit, and it’s really an organized effort for them to shoot down my candidacy as Ombudsman,” he said.
