Atty. Neil Abayon, member of Atty. Manases Carpio’s legal team
-
The AMLC report was unsigned
-
He said one can verify this through their YouTube channel, as Carpio’s camp has yet to receive an official copy from the Committee on Justice
-
“So that’s actually a very complicated issue, kung unsigned talaga considering, 1) prinesent ‘yun nung AMLC executive director. So they made it appear na that’s official AMLC records despite it being unsigned. It can still be questioned, ‘yung legality,”
-
He said it can be considered a “mere scrap of paper”
-
“‘Yung situation currently, medyo unreasonable na, considering na wala tayong official documents, hindi siya signed. Yet it was sent allegedly to media, tapos naging balita na siya all throughout the country, since last week or since the last two weeks,”
-
He said Carpio’s camp just wanted them to follow the rule of law, to give them proper notice. Carpio, Abayon said, was willing to cooperate
-
He clarified that in the April 22 hearing, Carpio was not subpoenaed, and yet his personal information was made public
-
“Madami po talagang questionable actions sa due process ‘yung House of Representatives,”
-
He argued that if Carpio was not an impeachable officer, why did the House divulge his personal information?
-
“Kaya ‘yung position namin, the right to privacy ni Atty. Mans was really violated,”
-
“Sa amin sir, pag mga unsigned pleadings, hindi ‘yan, walang legal value ‘yan sa korte. Itatapon lang ‘yan ng court,”
-
“Mayroon din silang selective application of the law. Sa BIR, they decided to uphold the confidentiality rules, pero sa AMLC, hindi. But both of them are (under) confidentiality laws. So that’s also a violation of due process and equal protection, kasi laws of the same kind should be applied equally,”
-
That’s why Atty. Caprio filed a criminal case last Monday for violation of the Bank Secrecy and the Data Privacy Act
